MINING companies backed by billions of dollars from the Trump administration face heightened scrutiny following the Democrats’ midterm election gains, Bloomberg reported.
Democratic lawmakers are preparing to investigate government investments in critical minerals companies, raising uncertainty over funding arrangements intended to reduce US dependence on China.
Several companies have attracted attention over their political connections and the administration’s unconventional financing arrangements, including equity stakes and stock warrants.
USA Rare Earth secured a $1.6bn agreement with the Commerce Department in January, including a government stake of roughly 10%. It separately appointed Cantor Fitzgerald, previously run by Commerce Secretary Howard Lutnick and now led by his sons, to arrange a $1.5bn private placement.
Vulcan Elements received a conditional $620m Pentagon loan commitment and a $50m equity investment months after a venture capital firm linked to Donald Trump Jr. acquired a stake.
Kaz Resources, which counts Trump’s sons among its indirect investors, has received preliminary indications of up to $1.6bn in government support.
The administration has also acquired stakes in MP Materials, Lithium Americas and Trilogy Metals.
Democrats could use congressional committees to demand documents, hold hearings and examine whether politically connected companies received preferential treatment.
Lawmakers have questioned how recipients were selected, the legal basis for investments and safeguards protecting taxpayers.
However, efforts to expand domestic critical minerals production have attracted bipartisan support, including under former president Joe Biden.
Existing binding agreements are unlikely to be overturned, but conditional financing and unfinished transactions face greater uncertainty.
“I don’t think the intent is necessarily to break existing binding legal contracts,” TD Cowen analyst John Miller told Bloomberg.
Consultant Ed Meir of Marex expects some investment plans to pause while earlier agreements are examined.
